The question of how people change artworks is important for the metaphysics of art. It’s relatively easy for anyone to change a painting or sculpture, but who may change a literary or musical work is restricted and varies with context. Authors of novels and composers of symphonies often have a special power to change their artworks. Mary Shelley revised Frankenstein, and Tchaikovsky revised his Second Symphony. I cannot change these artworks. In other cases, such as those involving jazz standards (...) and folk songs, performers and ordinary folks have more power to change artworks. My preferred explanation of these facts is the created-abstract-simples view, according to which literary and musical works, unlike paintings and sculptures, are created abstract objects that have no parts. On this view, the way to change a literary or musical work is for an individual, empowered by social practices, to change rules about how a literary work should be published or a musical work should be performed. A. R. J. Fisher and Caterina Moruzzi object that the created-abstract-simples view doesn’t allow for literary and musical works to genuinely change, and Nemesio Garcia-Carríl Puy objects that the view doesn’t allow for these artworks to be repeatable. The law views with suspicion statistical evidence, even evidence that is probabilistically on a par with direct, individual evidence that the law is in no way suspicious of. But it has proved remarkably hard to either justify this suspicion, or to debunk it. In this paper, we connect the discussion of statistical evidence to broader epistemological discussions of similar phenomena. We highlight Sensitivity – the requirement that a belief be counterfactually sensitive to the truth in a specific way – as (...) a way of epistemically explaining the legal suspicion towards statistical evidence. Still, we do not think of this as a satisfactory vindication of the reluctance to rely on statistical evidence. Knowledge – and Sensitivity, and indeed epistemology in general – are of little, if any, legal value. Instead, we tell an incentive-based story vindicating the suspicion towards statistical evidence. We conclude by showing that the epistemological story and the incentive-based story are closely and interestingly related, and by offering initial thoughts about the role of statistical evidence in morality. Structural universals are a kind of complex universal. They have been put to work in a variety of philosophical theories but are plagued with problems concerning their compositional nature. In this article, we will discuss the following questions. What are structural universals? Why believe in them? Can we give a consistent account of their compositional nature? What are the costs of doing so?

Human judgements are affected by the words in which information is presented —or ‘framed’. According to the standard gloss, ‘framing effects’ reveal counter-normative reasoning, unduly affected by positive/negative language. One challenge to this view suggests that number expressions in alternative framing conditions are interpreted as denoting lower-bounded (minimum) quantities. However, it is unclear whether the resulting explanation is a rationalising one. I argue that a number expression should only be interpreted lower-boundedly if this is what it actually means. I survey (...) how number expressions might be assigned lower-bounded meanings, due to their conventional semantics or pragmatic enrichment in context. I argue that deciding between these possibilities requires foundational philosophical input. (shrink)

This article surveys the latest research on risky-choice framing effects, focusing on the implications for rational decision-making. An influential program of psychological research suggests that people's judgements and decisions depend on the way in which information is presented, or ‘framed’. In a central choice paradigm, decision-makers seem to adopt different preferences, and different attitudes to risk, depending on whether the options specify the number of people who will be saved or the corresponding number who will die. It is standardly assumed (...) that such responses violate a foundational tenet of rational decision-making, known as the principle of description invariance. We discuss recent theoretical and empirical research that challenges the dominant ‘irrationalist’ narrative. These approaches typically pay close attention to how decision-makers represent decision problems (including their interpretation of numerical quantifiers or predicate choice) and they highlight the need for a more robust characterization of the description invariance principle. We conclude by indicating avenues for future research that could bring us closer to a complete—and potentially rationalizing—explanation of framing effects. (shrink)

In the middle of last century metaphysics was widely criticized, ridiculed, and committed to the flames. During this period a handful of philosophers, against several anti-metaphysical trends, defended metaphysics and articulated novel metaphysical doctrines. Donald C. Williams was one of these philosophers. But while his contributions to metaphysics are well known his defence of metaphysics is not and yet it played a key part in the development and revival of metaphysics. In this paper I present his defence of metaphysics in (...) its historical context. I also show how his defence is relevant in response to recent attacks on metaphysics. (shrink)

A number of authors have suggested that a conditional analysis of dispositions must take roughly the following form: Thing X is disposed to produce response R to stimulus S just in case, if X were exposed to S and surrounding circumstances were auspicious, then X would produce R. The great challenge is cashing out the relevant notion of ‘auspicious circumstances’. I give a general argument which entails that all existing conditional analyses fail, and that there is no satisfactory way to (...) define ‘auspicious circumstances’ just in terms of S, R, and X. Instead, I argue that the auspicious circumstances C for the manifestation of a disposition constitute a third irreducible element of that disposition, and that to pick out (or to ‘individuate’) that disposition one must specify C along with S and R. This enables a new conditional analysis of dispositions that gives intuitively satisfying answers in cases that pose problems for other approaches. (shrink)

I apply the notion of truthmaking to the topic of fundamentality by articulating a truthmaker theory of fundamentality according to which some truths are truth-grounded in certain entities while the ones that don't stand in a metaphysical-semantic relation to the truths that do. I motivate this view by critically discussing two problems with Ross Cameron's truthmaker theory of fundamentality. I then defend this view against Theodore Sider's objection that the truthmaking approach to fundamentality violates the purity constraint. This chapter explores the philosophical development of Alexander’s empiricism, interest in experimental psychology, and its connection to realism and its subsequent rise in the early twentieth century. His early interests are most notably his rejection of British idealism and an empiricist tendency derived in part from classical empiricism and empirical developments in psychology. It is argued that Alexander arrives at realism through his work on psychology, thus revealing that the rise of realism has some psychological origins. His philosophical method is (...) also analysed in detail and it is shown that many of his arguments should be understood as following this method and that many objections to his arguments for realism and against his theory of perception can be resisted when this method is taken into consideration. Samuel Alexander was one of the first realists of the twentieth century to defend a theory of categories. He thought that the categories are genuinely real and grounded in the intrinsic nature of Space-Time. I present his reduction of the categories in terms of Space-Time, articulate his account of categorial structure and completeness, and offer an interpretation of what he thought the nature of the categories really were. I then argue that his theory of categories has some advantages over competing (...) theories of his day, and finally draw some important lessons that we can learn from his realist yet reductionist theory of categories. Recent studies indicate that patients who are diagnosed with vegetative states may retain more awareness than their clinical assessments suggest. Disorders of consciousness traditionally have been diagnosed on the basis of outwardly observable behaviors alone, but new functional imaging studies have shown surprising levels of brain activity in some patients, indicating that even higher-level cognitive functions like language processing and visual imagery may be preserved. For example, one recently developed method purports to detect voluntary mental imagery solely on the basis (...) of neural response patterns observed with functional magnetic resonance imaging. This line of research has already led to some widely reported cases of patients who were discovered to have more brain activity than expected. In November 2009, Rom Houben, a Belgian man who was thought to be in a coma for 23 years, was diagnosed with locked-in syndrome through the use of neuroimaging; however, that assessment was later overturned by further testing. In the Critique of Pure Reason, Kant criticizes his predecessors, specifically Locke and Leibniz, in their one-sided reductions of representation to a single faculty. In his 1802 dialogue Bruno, Schelling develops this discussion into a criticism of Kant’s own one-sided idealism. Focusing on these developments makes clear the manner in which Schelling sees himself as advancing beyond both pre-Critical realisms and Kant’s transcendental idealism. He subsumes realism and Kantian idealism within his own absolute standpoint, providing a ground and rationale for (...) both types of philosophical system as independent approaches, and he asserts that the ultimate foundation and unity of these systems of philosophy is in the absolute which is beyond conceptual thought. Samuel Alexander was a central figure of the new wave of realism that swept across the English-speaking world in the early twentieth century. His Space, Time, and Deity (1920a, 1920b) was taken to be the official statement of realism as a metaphysical system. But many historians of philosophy are quick to point out the idealist streak in Alexander’s thought. After all, as a student he was trained at Oxford in the late 1870s and early 1880s as British Idealism was beginning (...) to flourish. This naturally had some effect on his philosophical outlook and it is said that his early work is overtly idealist. In this paper I examine his neglected and understudied reactions to British Idealism in the 1880s. I argue that Alexander was not an idealist during this period and should not be considered as part of the British Idealist tradition, philosophically speaking. (shrink)

Although there is clearly a need for evidenced‐based behavioral or biomedical prevention or treatment programs for suicide, substance abuse, and sexual health targeted to members of the LGBT population under the age of eighteen, few such programs exist, due in substantial part to limited research knowledge. Ambiguities in regulations that govern human subjects protections and the related inconsistencies in institutional review board (IRB) interpretations of regulatory language are the key reason for the lack of rigorous clinical trial evidence to support (...) treatment choices and prevention approaches to reducing health disparities for this population. Given the socially sensitive nature of suicide, substance abuse, and HIV and STI research in general and LGBT research specifically, in the absence of empirical data to guide their decisions, IRBs must often rely on subjective judgments of minimal risk, which can lead to overestimation of the magnitude and probability of psychological, social, and informational harms that might arise from LGBT youth participation in clinical trials. In addition, more than other youth, LGBT adolescents whose families are unaware of their sexual orientation or gender identity or whose families have victimized them on account of it may be reluctant to participate in studies that require guardian permission. This, in turn, intensifies problems of recruitment and unbiased sampling. However, many IRBs are reluctant to apply federal regulations permitting waiver of guardian permission under conditions in which such permission is clearly not “feasible” or “reasonable” to require. Consequently, many investigators have excluded LGBT individuals under eighteen years of age in health intervention research proposals because of anticipated or actual difficulties obtaining IRB approval. This situation is in conflict with current ethical discourse focusing on the right of youths to participate in trials that will protect them from receiving developmentally untested, inappropriate, and unsafe treatments. In this article, we describe these barriers and recommendations for providing LGBT youth safe and fair access to health research. (shrink)

The debate between Semantic Minimalism and Radical Contextualism is standardly characterized as concerning truth-evaluability—specifically, whether or not sentences require rich contextualization in order to express complete, truth-evaluable contents. In this paper, I examine the notion of truth-evaluability, considering which kinds of mappings it might require from worldly states of affairs to truth-values. At one end of the spectrum, an exhaustive notion would require truth-evaluable contents to map all possible states of affairs to truth-values. At the other end, a liberal notion (...) would require only that truth-evaluable contents map at least one possible state of affairs to at least one truth-value. I show that both Minimalists and Radical Contextualists rely on some intermediate, moderately strict notion of truth-evaluability, falling between these two poles. I consider four ways in which such a notion could be defined. However, I argue that each of these is ultimately implausible, giving us no reason to favour a moderately strict notion of truth-evaluability over the liberal alternative. This suggests that the debate must shift to more moderate ground; rather than concerning the in principle possibility of truth-evaluable contents, it fundamentally hinges on their explanatory value. More generally, paying close attention to the notion of truth-evaluability allows us to tease apart distinct strands in the Minimalism-Contextualism debate, and gain a better appreciation of what is at stake. Can the Hippocratic and Judeo-Christian traditions be synthesized with contemporary thought about practical reason, virtue and community to provide real-life answers to the dilemmas of healthcare today? Bishop Anthony Fisher discusses conscience, relationships and law in relation to the modern-day controversies surrounding stem cell research, abortion, transplants, artificial feeding and euthanasia, using case studies to offer insight and illumination. What emerges is a reason-based bioethics for the twenty-first century; a bioethics that treats faith and reason with equal seriousness, that (...) shows the relevance of ancient wisdom to the complexities of modern healthcare scenarios and that offers new suggestions for social policy and regulation. Philosophical argument is complemented by Catholic theology and analysis of social and biomedical trends, to make this an auspicious example of a new generation of Catholic bioethical writing which has relevance for people of all faiths and none. In this paper we explore the connection between the act of teaching and the imparting of knowledge. Our overarching aim is to demonstrate that the connection between them is less tight than one might suppose. Our stepping off point is a recent paper by David Bakhurst who (on one reading, at least) takes a strong view, opposed to our own. On our reading, Bakhurst argues that there is a tight conceptual connection between teaching and the imparting of knowledge. We argue (...) that this is not the case; the connection does not hold. We then consider several ways we might weaken the alleged conceptual connection between teaching and knowledge, finally considering two ways of severing the conceptual connection altogether, whilst at the same time allowing that much teaching does indeed lead to the imparting of knowledge. In this paper I argue that, according to Plato’s Statesman, true statesmen directly control, administer, or govern none of the affairs of the city. Rather, administration and governance belong entirely to the citizens. Instead of governing the city, the task of the statesman is to facilitate the citizens’ successful self-governance or self-rule. And true statesmen do this through legislation, by means of which they inculcate in the citizens true opinions about the just, the good, the fine, and the opposites of (...) these. (shrink)

Almost one-third of all U.S. Americans believe that Jesus Christ will return to Earth in the next 40 years, thereby signaling the end of the world. The prevalence of this end-times theology has meant that sustainability initiatives are often met with indifference, resistance, or even hostility from a significant portion of the American population. One of the ways that the scientific community can respond to this is by making scientific discourse, particularly as related to sustainability, more palatable to end-times believers. (...) In this paper, I apply a historical–ecological framework, which emphasizes the interdisciplinary study of landscapes to understand long-term human–environment interactions, to three millennial religious groups that formed communes in nineteenth century America. The Shakers, Inspirationalists, and Mormons all blended deep beliefs in end-times theology with agricultural practices that were arguably more sustainable than those in use in the mainstream, and their ability to reconcile eschatology with sustainability provides us with potential lessons. By examining the history, doctrines, and agroecology of these nineteenth century communes, I propose communication strategies based in autonomy, institutional support, multigenerational narratives, and anthropocentricism as potential pathways for a more productive dialogue between advocates of sustainability initiatives and end-times believers in the modern United States. This article refines a foundational tenet of rational choice theory known as the principle of description invariance. Attempts to apply this principle to human agents with imperfect knowledge have paid insufficient attention to two aspects: first, agents’ epistemic situations, i.e. whether and when they recognize alternative descriptions of an object to be equivalent; and second, the individuation of objects of description, i.e. whether and when objects count as the same or different. An important consequence is that many apparent ‘framing effects’ (...) may not violate the principle of description invariance, and the subjects of these effects may not be irrational. (shrink)

Schelling’s 1794 commentary on the Timaeus makes extensive use of Plato’s Philebus, particularly the principles of limit and unlimited. In this article, we demonstrate the resonances between Schelling’s 1794 treatment of the metaphysics of the Philebus and his 1798 philosophy of nature. Attention to these resonances demonstrates an underexplored but important debt to Plato in Schelling’s philosophy of nature. In particular, Schelling is indebted to Plato’s late metaphysics in his model of the iterative combination of two basic principles: a productive, (...) positive principle, akin to Plato’s unlimited, and a limiting, negative principle, akin to Plato’s limit. In Schelling’s philosophy of nature, the iterative interaction of these principles both provides a common ground for and accounts for the differences between inorganic and organic nature. (shrink)

The premium on authenticity attributed to aesthetic appreciation and judgment of ruins is unnecessary, even while valuable for engagement with ruins as historical objects. I contrast values we assign to architectural ruins and to nongenuine, sham ruins. Ruins are components of built past architectural objects; sham ruins are components of fantasy, unbuilt architectural objects. Taking architectural objects as abstractions realized or realizable as built objects, ruins and sham ruins alike are built instances of corresponding abstract objects. The question is not whether [“true” and “false”] are in practice applied to ethical statements, but whether, if they are so applied, the point of doing so would be the same as the point of applying them to statements of other kinds, and if not, in what ways it would be different. (Michael Dummett, quoted in Lynch 2001: 273) When I claim that “my bike is dirty” or that “the dinner is burning” what makes it the case that what I (...) say is true or false? One intuitive answer would be that the statements are true if, as a matter of fact, my bike is dirty or the dinner is burning. Considering our day-to-day talk reveals that we believe there are facts which make our common-or-garden-variety statements true. We don’t of course believe that we know all such facts but nevertheless we still believe that if what we say is true then some fact makes it so. (shrink)

In his canonical articles Against Settlement and The Forms of Justice, Owen Fiss argues that the erosion of civil litigation harms the deliberative process and the elucidation of public values in society. By revealing the hidden public dimension underlying not only public law litigation, but also the adjudication of private law disputes, Fiss’s argument can be conceptualized as posing a challenge to the public/ private distinction. At the same time, Fiss’s critique reinforces the public/private divide by placing settlement and civil (...) litigation on either side of the borderline. In this Article, we set out to dispel the prevalent depiction of settlement as inherently private, and to challenge the binary logic of the private/public distinction as it is understood to apply to settlement. We show how settlements have the capacity to fulfill each and every one of the public functions attributed to the civil trial, including the elaboration of norms, the discovery of facts, the facilitation of democratic participation, and the creation of public narratives. The functional, process-oriented approach we offer depicts settlement as a device that does not stand in opposition to the promotion of rule of law values - but rather as an institution that enhances the articulation of public norms. Our discussion progresses against the background of three settlement arenas: settlement in the classic civil suit context, structural reform suits, and transnational Holocaust litigation. (shrink)
